Entry into force of the Merchant Shipping (Community Vessel Traffic Monitoring and Information System) Order of 2012

The Cyprus Department of Merchant Shipping has announced that the Merchant Shipping (Community Vessel Traffic Monitoring and Information System) Order of 2012, issued under section 351 of the Merchant Shipping (Community Vessel Traffic Monitoring and Information System) Laws of 2004 and 2010, entered into force on 16 March 2012. The Order transposes EU Directive 2011/15/EC amending Directive 2002/59/EC.

The Order replaces the Second and Fourth Schedules of the Laws, respectively titled “Mandatory On-Board Equipment” and “Measures that the Committee on Places of Refuge-Safety may take to Ensure Maritime Safety, Safety of Life and the Protection of the Environment” with the latest versions introduced by Directive 2011/15/EC.

Directive 2011/15/EC refers to the revocation of International Maritime Organization (IMO) Resolution MSC 150(77)3 and its replacement by IMO Resolution MSC 286(86)4 and for substitution of the reference to Resolution MSC 150(77) in article 12(1)(b) of Directive 2002/59EC as amended. There is no need for amendment of the Merchant Shipping (Community Vessel Traffic Monitoring and Information System) Laws of 2004 and 2010 since they define Resolution MSC 150(77) as being the up to date version of the Resolution.
