Dispute resolution seminar in Kazakhstan

Costas Stamatiou, a partner in our dispute resolution department, was a guest speaker in a seminar held in Astana, Kazakhstan, on dispute resolution involving Kazakh parties outside Kazakhstan. The seminar was organised in conjunction with Grata Law Firm, a leading Central Asia and Caspian region law firm, and Herbert Smith, the respected international law firm.

The seminar was modelled on a case study and focused on the resolution of complex but frequently encountered scenarios involving contractual disputes, fraud and conspiracy as well as the tracing, freezing and recovery of assets. It evaluated the substantive, procedural and practical tools available for Kazakh parties considering the options for dispute resolution in the foreign courts or arbitration. 

The seminar was co-chaired by Simon Bushell, partner at Herbert Smith, London and Aidar Sarymsakov, senior partner at Grata, Kazakhstan. Costas Stamatiou provided insight on the Cyprus aspects of the case study including provisional measures such as Mareva freezing injunctions and Norwich Pharmacal disclosure orders that may be obtained from Cyprus courts in support of court and arbitration proceedings in Cyprus or overseas.

The seminar delegates included representatives of various governmental authorities and private firms including the many energy conglomerates that are active in the oil rich territories of Kazakhstan.
